Welcome to FreshMart Grocery & Food. These Terms of Use ("Terms") govern your use of our online grocery and food delivery platform. By accessing or using our services, you agree to be bound by these Terms.
Service Description: FreshMart provides an online platform for ordering groceries, fresh produce, and food from our inventory and partner restaurants, with delivery to your specified address within our service areas.
Account Registration: To place orders, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. You must be at least 18 years old to create an account and place orders.
Orders and Pricing: Product prices are listed in Indian Rupees (INR) and may change without notice. While we strive for accuracy, pricing or product information errors may occur. We reserve the right to cancel orders affected by pricing errors. Orders are subject to product availability. If items are unavailable, we will notify you and offer alternatives or refunds.
Payment: We accept UPI, credit/debit cards, net banking, digital wallets, and Cash on Delivery (COD). Payment must be completed at the time of order (except COD). All online payments are processed through secure third-party payment gateways. You authorize us to charge the total order amount including applicable taxes and delivery fees.
Delivery: Standard delivery takes 60-90 minutes from order confirmation. Delivery times are estimates and may vary based on location, traffic, weather, and order volume. Orders above Rs.499 qualify for free delivery; standard delivery charges apply otherwise. You must provide accurate delivery address and be available to receive the order. We are not liable for delays caused by circumstances beyond our control.
Returns and Refunds: Eligible products (damaged, expired, incorrect items) can be returned as per our return policy. Fresh produce, perishable items, and consumed products generally cannot be returned unless defective. Return requests must be made within the specified timeframe. Refunds will be processed to the original payment method within 7-10 business days after approval.
Food Safety and Quality: We strive to deliver fresh, quality products. However, food products have natural variations. For food orders from partner restaurants, food preparation and quality are the responsibility of the respective restaurant. We facilitate the order and delivery only.
Prohibited Activities: You agree not to use our platform for any unlawful purpose, provide false information, interfere with platform security, attempt unauthorized access, violate intellectual property rights, or engage in fraudulent activities.
Intellectual Property: All content on our platform, including text, graphics, logos, images, and software, is owned by FreshMart or licensed to us and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
Disclaimer of Warranties: Our services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free, or secure service. Product descriptions and images are for illustration purposes and may not be entirely accurate.
Limitation of Liability: FreshMart, its affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid for the relevant order.
Indemnification: You agree to indemnify and hold harmless FreshMart, its affiliates, officers, employees, and partners from any claims, damages, losses, or expenses arising from your violation of these Terms or misuse of our services.
Modification of Terms: We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our platform. Continued use after changes constitutes acceptance of modified Terms.
Termination: We may suspend or terminate your account at our discretion for violation of these Terms, fraudulent activity, or any reason we deem necessary. You may terminate your account by contacting customer support.
Governing Law: These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in [City], India.
