By accessing or using the Hamdan Real Estate platform, you agree to be bound by these Terms of Use. If you do not agree, please do not use our services.

## 2. Platform Services

Hamdan Real Estate provides: - Property search and listing platform - Property buying, selling, and rental services - Off-plan project information and investment services - Property management and investor services - Agent and broker portal access - Customer and developer portals - AI-powered property matching and chatbot - Virtual tours and property viewing scheduling

## 3. User Accounts

### Registration - You must provide accurate and complete information - You are responsible for maintaining account security - You must be 18 years or older to create an account - One user may have multiple roles (customer, seller, investor)

### Account Types - Customer/Buyer - Property Seller/Owner - Tenant/Renter - Real Estate Agent/Broker - Developer - Property Manager

## 4. Property Listings

### Accuracy - Property information is provided by sellers, developers, and agents - We strive for accuracy but do not guarantee all details - Prices, availability, and specifications are subject to change - Users should verify information independently

### Property Images and Virtual Tours - Images may include artist impressions and staged photography - Virtual tours and floor plans are for reference only - Actual properties may vary from representations

## 5. Property Transactions

### Buying and Renting - Property viewings are by appointment only - Offers and negotiations are facilitated by our agents - Final transactions require proper documentation and legal compliance - We are not a party to the final sale/rental agreement - Buyers/tenants are responsible for due diligence

### Selling and Listing - Sellers must provide accurate property information - Sellers grant us license to market their properties - Commission rates and terms are agreed upon listing - We reserve the right to reject or remove listings

## 6. Fees and Payments

### Commission Structure - Buyer/tenant commission: As per agreement (typically 2%) - Seller commission: As per listing agreement (typically 2-5%) - Rental agency fee: Typically 5% of annual rent - Property management fees: As per service agreement

### Payment Terms - Booking amounts and deposits are non-refundable unless specified - Payment plans follow developer/seller terms - Commission is payable upon successful transaction

## 7. Off-Plan Projects

- Off-plan information is sourced from developers - Payment plans and completion dates are subject to developer terms - Construction delays and specification changes may occur - We are not responsible for developer performance - Investors should review developer contracts carefully

## 8. Agent and Broker Services

- Agents operate under real estate regulations (RERA) - Agent performance and conduct is monitored - Users can request different agents if needed - Commission splits are governed by agent agreements

## 9. AI Features and Chatbot

- AI recommendations are based on algorithms and user preferences - AI-generated content (descriptions, analyses) should be verified - Chatbot responses are automated and may have limitations - Human agent support is available for complex queries

## 10. WhatsApp Communications

- WhatsApp integration is subject to WhatsApp terms - Automated messages include welcome, follow-ups, reminders - Users can opt out of WhatsApp communications - WhatsApp conversations may be monitored for quality

## 11. Intellectual Property

- Platform content, design, and technology are our property - Property listings and images are licensed for platform use - Users may not reproduce or redistribute content without permission - User-generated content may be used by us for platform purposes

## 12. Prohibited Activities

Users may not: - Provide false or misleading information - Engage in fraudulent transactions - Harass agents, sellers, or other users - Scrape or copy platform content systematically - Interfere with platform operation - Violate any applicable laws or regulations

## 13. Disclaimers

- Platform is provided "as is" without warranties - We do not guarantee property availability or accuracy - We are not liable for user disputes or transaction failures - Third-party services (virtual tours, maps) are subject to their terms - Investment returns and ROI projections are estimates only

## 14. Limitation of Liability

We are not liable for: - Property transaction disputes - Developer defaults or construction issues - Market fluctuations affecting property values - Third-party service failures - Indirect, consequential, or punitive damages

## 15. Regulatory Compliance

- All transactions must comply with UAE real estate laws - Properties must meet RERA and DLD requirements - Users are responsible for obtaining proper permits and registrations - We cooperate with regulatory authorities as required

## 16. Dispute Resolution

- Disputes should first be raised with our support team - Unresolved disputes may be escalated to management - Final disputes are subject to UAE jurisdiction - RERA complaint mechanisms are available for regulated matters

## 17. Privacy and Data

- User data is governed by our Privacy Policy - We collect and process data as described in Privacy Policy - Users consent to data sharing for transaction purposes

## 18. Modifications

- We may modify these terms at any time - Material changes will be notified via email or platform - Continued use constitutes acceptance of modified terms

## 19. Termination

- We may suspend or terminate accounts for violations - Users may close accounts with proper notice - Termination does not affect completed transactions or obligations
